A BILL to amend article five, chapter twenty-eight of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section nine, relating to state correctional and penal institutions; state penitentiary; and permitting recovery of costs for repairs for damage caused by convicts to be recovered from income or personal property of convict.

Be it enacted by the Legislature of West Virginia:
That article five, chapter twenty-eight of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section nine, to read as follows:
ARTICLE 5. THE PENITENTIARY.
§28-5-9. Recovery of cost of repairs for damages caused by
convict from income or personal property.

The warden may recover from the money, valuables and earnings or any other personal property of a convict, the cost of repairing any damages to the penitentiary caused by that convict.



NOTE: This bill authorizes the Warden of the State Penitentiary to collect the cost of repairing damages caused by a convict, from income, etc., of the convict.
